9:00 - 10:00 a.m.- Collective Bargaining in the Public Sector

The COVID-19 pandemic changed the way that municipalities operate in many ways. One of the key ways in which that change continues to evolve is with collective bargaining. Public employers now are confronted with claims for hazard/premium pay, requests from employees to receive portions of American Rescue Plan Act money and increasingly aggressive demands for changes in wages, benefits and other conditions of employment. During this session, the presenters will focus on common mistakes public employers make at the bargaining table and in interest arbitration and how to avoid them. This session will serve as a great resource for any solicitor who represents a public employer.

10:10 a.m. - 11:10 a.m. - It’s Raining Lawsuits – Trends in Municipal Stormwater Litigation

This session will provide solicitors with a solid foundation for understanding stormwater management litigation trends, including the types of claims being brought, issues affecting defenses of those claims, and best practices to avoid claims in the first place.

11:20 a.m. - 12:20 p.m. - Implementing Pennsylvania’s New Police Background Check and Mental Health Laws

This session will highlight the statutory and regulatory requirements for townships and their police departments to properly implement Act 57, relating to background checks for law enforcement employment purposes and Act 59, relating to mental health evaluations and Post Traumatic Stress Disorder (PTSD) for law enforcement officers. It will also provide solicitors and, by extension, township boards and staff with the best practices for implementation and recognizing the pitfalls.

12:20 - 1:00 p.m. -  Lunch

1:00 - 2:00 p.m. -  TBD

2:15- 3:15 p.m. - Should I Do That? – Common Municipal Ethics Issues

In this session, we will discuss a wide variety of township-related scenarios that may trigger potential issues under the Pennsylvania Rules of Professional Conduct or the Pennsylvania Ethics Act.
